- American Revolutionary War Pension Application (This is a direct transcript, including spelling errors, etc):
State of Kentucky: Pulaski County Court, Sct On this 18th day of November in the year of Our Lord One Thousand eight Hundred and Thirty Three personally appeared in open Court before the County Court of Pulaski County State of Kentucky now sitting as a Court Josiah Earp, aged Seventy two years a resident citizen of Pulaski County State of Kentucky, who being first duly sworn according to law doth on his Oath make the following Declaration in order to obtain the benifit of the act of Congress passed June 7th 1832.
That he entered the service of the United States under the following named Officers and served as herein stated. That while a resident of Montgomery County State of Maryland, according to his present reccollection, in the month of March 1781 he volunteered for the Term of nine months in the company of Captian John Nichols, the Lieutenants name was Thomas Nichols. after he volunteered he was marched to George Town as here after stated. There was there also another Company of Militia and a Company of Light horse but he does not now reccollect under whose Command we were rendevouzed at Montgomery Courthouse in the state aforesaid. and at that place received the proper arms and accoutrements for the service and was there a short time harried & exercised. and from thence was Marched to George Town, now in the District of Columbia, and was there stationed and remained there engaged until news arrived that Lord Cornwallis had retreated towards North carolina.
Was then directed by the Commanding Officers to return home but to carry with him his arms & other accoutrements and to hold himself ready to march into the service immediately when called on the whole company were dispersed under like orders. in a few days after his return from George Town he was again together with the rest of the Company to which he belonged ordered into the service of the United States by his Commanding Officers and was ordered to March to Demfries [Dumfries] a small Town beyond Blademburg [Bladensburg]. and while on the March, our Officers were informed there was no need of our Services at that point, and was then directed to return home but to hold ourselves in readiness to March again into the service when called on.
And after the Surrender of Lord Cornwallis he togother with the rest of the Company was called in to the Service by the Commanding Officers and were then marched to Frederick Town, Maryland to Guard the prisoners taken at the Surrender of Cornwallis and continued there engaged in that service until about the 15th day of December of that year and was then discharged from the service he received no discharge in Writing. at Christmas his nine months would have expired and been completed.
From the long lapse of time, old age and consequent loss of memory he is unable to state with exact prescision how long he was actually employed and engaged in the service, but not less than Eight Months. he was allways ready at any time but actually engaged eight months. He was born in Montgomery County State of Maryland on the 10th day of March 1761, the day he does not know, according to an account of his age which he supposes came from his Parents. He is himself entirely illiterate not being able to read or write he has no Record of his age. He was living in said Montgomery County when he was called into the service. After the Revolutionary war he continued to reside in said county until he moved to the state of North carolina in which state he resided about four or five years and from there about Sixteen years anterior to this he removed to and settled in Pulaski County Kentucky where he now lives.
He volunteered in the Service he has stated the names of his Officers who were with the Troops with whom he served. and the general circumstances of the Tenure. He received no written discharge.that he has no Documentary evidence whatever of his services and Knows of no person whose Testimony he can procure who can testify to his Service. He is Known to Martin Owens a Clergyman and Daniel F James residents of his present neighbourhood, who can testify to his character for veracity and their belief of his services as a soldier of the Revolution. He hereby relinquishes every claim whatever to a pension or annuity except the present and declares that his name is not on the pension roll of the agency of any state or Territory.

We Martin Owens a Clergyman residing in the County of Pulaski and Daniel F James residing in the Same, hereby certify that we are well acquainted with Josiah Earp who has Subscribed and Sworn to the above Declaration that we believe him to be Seventy two years of age that he is reputed and believed in the neighbourhood where he resides to have been a soldier of the Revolution and that we concur in that opinion.

And the said Court do hereby Declare their Opinion after the investigation of the matter and after putting the interrogatories prescribed by the War Department that the above named applicant was a Revolutionary Soldier and served as he states. And the Court further certifies that it appears to them that Martin Owens who has signed the preceding certificate is a Clergyman, resident in the County of Pulaski and that Daniel F James who has Signed the same is also a resident in the county of Pulaski and is a credible person and that their statement is entitled to credit.

Notice of Death of Soldier of the Revolution Pensioner:
Be it known that before me James DeHoff a Justice of the Peace in and for the County and State aforesaid duly authorised to Administer Oaths personally appeared George Randol and made Oath in due form of law that he is the Administrator of Josiah Earp deceased the identical person who was a revolutionary Pensioner of the United States and is now dead and to whom a certificate of Pension was issued which is herewith surrendered that the deceased Pensioner resided in the County and State aforesaid for the space of about thirty years before his death and that previous thereto he resided in the state of North Carolina that he left no Widow and the following are his only Children Singleton Earp, Allin Earp, Eleanor Randol and Jemima Randol.

Know all men by these presents that I George Randol Administrator of the estate of Josiah Earp deceased who was a Revolutionary Pensioner of the United States do hereby constitute and appoint Cyrenius W Gilmore of the City of Louisville in the state of Kentucky my true and lawful attorney for me and in my name to receive from the agent of the United States for paying Pensions in the City of Louisville in the state of Kentucky the balance of decedents Pension from the 4th day of September 1844 to the 25th of November 1844 being the day of his death.

Be it known that on the 27th day of August 1853 before the subscriber a Justice of the Peace in and for said County duly authorized by law to administer Oaths personally appeared George Randol Administrator of Josiah Earp deceased and acknowlidged the foregoing Power of attorney to be his act and deed.

I James D Allcorn Clerk of the County Court holden at Somerset in and for Pulaski County do hereby certify that satisfactory evidence has been exhibited to said Court that Josiah Earp deceased was a revolutionary pensioner of the United Sates at the rate of Twenty dollars per annum. Was a resident of the County of Pulaski in the State of Kentucky and died in said County and State on the 25th day of November in the year 1844. That he left no Widow and the following are his only Children Singleton Earp - Allin Earp - Elenor Randol and Jemima Randol.

At a County Court held for Pulaski County at the Courthouse in the Town of Somerset on Monday the 20th day of January 1845
On the Motion of George Randol who made Oath as required by Law Ordered that Certificate be granted him for Obtaining Letters of Administration in due form of the goods chattles and credits of Josiah Earp deceased.Whereupon said George Randol with James Randol and Hocker Earp his securities executed and acknowledged Bond to the Commonwealth of Kentucky in the Penalty of One hundred dollars Conditioned according to Law.

Be it known that on the 31st day of August of 1853 before me Pension agent personally appeared Cyrenius W Gilmore the Attorney named in the foregoing Power of Attorney and made Oath that he has no interest whatever in the money he is authorized to receive by virtue of the foregoing Power of Attorney, either by any pledge Mortgage sale assignment or Transfer and that he does not know or believe that the same has been disposed of in any way whatever.
